1. Introduction

These Terms and Conditions ("Terms") govern your use of services provided by The Busy Food Company ("we," "us," "our"), including our website (www.thebusyfoodco.co.uk), weekly delivery service, catering services, and any other products or services we offer. By placing an order, using our website, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

2. Service Description

2.1 Weekly Home Deliveries

The Busy Food Company offers a weekly delivery service of freshly prepared meals, handcrafted pies, and other food items to customers within our designated delivery areas. Our menu changes weekly, featuring seasonal ingredients and customer favourites. Orders must be placed by the specified deadline (currently 3:00 PM on Wednesday) for delivery that week.

2.2 Catering Services

We provide catering services for corporate events, private functions, and celebrations. Catering services are subject to availability and require advance booking. Specific arrangements, including menu selection, delivery or setup times, and any special requirements, will be agreed upon at the time of booking.

2.3 Local Partnerships

We supply handmade pies, sausage rolls, scotch eggs, and other products to local bars and venues under our Crowther's Gourmet Pies brand. These wholesale arrangements are subject to separate agreements with our business partners.

3. Ordering and Payment

3.1 Order Acceptance

All orders placed through our website, by phone, or by email are subject to acceptance by us. We reserve the right to decline any order at our discretion. An order is not confirmed until you receive an order confirmation from us, typically via email.

3.2 Accuracy of Information

When placing an order, you are responsible for providing accurate and complete information, including contact details, delivery address, and any dietary requirements or allergies. We cannot be held responsible for delays, delivery issues, or other problems arising from inaccurate information provided by you.

3.3 Payment Methods

We accept payment through the following methods:

Credit and debit cards

Bank transfers (for catering orders)

All payments must be made in full at the time of ordering unless alternative arrangements have been explicitly agreed upon for catering or wholesale orders.

3.4 Pricing and Taxes

All prices displayed on our website or provided in quotations are in British Pounds (GBP) and include VAT where applicable. We reserve the right to change our prices at any time, but changes will not affect orders that have already been confirmed.

4. Delivery and Collection

4.1 Delivery Areas

Starting June 1st, 2025, we offer two delivery options:

Local Delivery: We currently deliver directly to Preston, Blackburn, Leyland, and Chorley areas.

Nationwide Delivery: From June 1st, 2025, we will offer nationwide delivery across the UK via next-day courier service. For further details on the areas we offer our delivery service to please consult Weekly Delivery

4.2 Delivery Times

Local Deliveries: We will provide an estimated delivery time when confirming your order. While we strive to deliver within the specified timeframe, delivery times are not guaranteed and may be affected by factors beyond our control, such as traffic or weather conditions.

Nationwide Deliveries: Our nation wide courier is APC who offer a next day by 4pm service. You will receive either text message or an email from APC providing you with a 2 hour window for delivery. If you know that you won't be home at that time alternative arrangements can be made directly with APC.

4.3 Collection Option

Customers may opt to collect their orders from our premises instead of having them delivered. Collection times will be specified in your order confirmation.

4.4 Failed Deliveries

If we are unable to complete a delivery because no one is available to receive it and no alternative delivery instructions have been provided, we may leave the order in a safe place if possible or return it to our premises. In such cases, we will attempt to contact you to arrange redelivery, which may incur an additional fee.

5. Food Safety and Quality

5.1 Food Handling

All our food is prepared in accordance with relevant food safety regulations. We maintain high standards of hygiene and quality control throughout our food preparation and delivery processes.

5.2 Allergens and Dietary Requirements

While we take reasonable steps to accommodate dietary requirements and provide allergen information, our kitchen handles various ingredients, including common allergens. We cannot guarantee that any product is entirely free from allergens. If you have severe allergies or specific dietary requirements, please contact us before placing an order.

5.3 Storage and Consumption

Upon delivery, you are responsible for the proper storage and timely consumption of food items. We provide storage and reheating instructions where applicable, and these should be followed to maintain food quality and safety.

6. Cancellations and Refunds

6.1 Order Cancellation

For weekly deliveries, we do not accept cancellations and payment is expected for all items ordered. For catering services, our cancellation policy will be specified in your catering agreement, typically requiring notice of at least 48-72 hours depending on the size and nature of the event.

6.2 Refund Policy

Refunds will be issued for:

Orders cancelled within the permitted timeframe, missing or significantly damaged items, provided we are notified within 24 hours of delivery, items that fail to meet reasonable quality standards, subject to our assessment.

Refunds will be processed using the original payment method unless otherwise agreed.

6.3 Quality Issues

If you experience any issues with the quality of our products, please contact us within 24 hours of delivery with details of the problem and, where possible, photographs of the affected items. We will assess each case individually and offer an appropriate resolution, which may include replacement, refund, or credit for future orders.

7. Intellectual Property

7.1 Website Content

All content on our website, including text, graphics, logos, images, and software, is the property of The Busy Food Company or our content suppliers and is protected by copyright and other intellectual property laws. Unauthorized use, reproduction, or distribution of this content is prohibited.

7.2 Trademarks

"The Busy Food Company," "Crowther's Gourmet Pies," and any associated logos are trademarks of our business. You may not use these trademarks without our prior written consent.

8. Limitation of Liability

8.1 Service Limitations

While we strive to provide reliable services, we cannot guarantee that our website will be uninterrupted, timely, secure, or error-free. We reserve the right to suspend, restrict, or terminate access to our website without prior notice.

8.2 Liability Cap

To the maximum extent permitted by law, our liability for any claim arising from or related to our products or services shall not exceed the amount paid by you for the specific order giving rise to such claim.

8.3 Exclusions

Nothing in these Terms excludes or limits our liability for:

Death or personal injury caused by our negligence

Fraud or fraudulent misrepresentation

Any liability that cannot be excluded or limited by law

9. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to natural disasters, adverse weather conditions, pandemics, power failures, internet service provider failures, strikes, or government restrictions.

10. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our data practices as described in our Privacy Policy.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

11.2 Dispute Process

11.3 Legal Proceedings

Any legal proceedings related to these Terms shall be brought in the courts of England and Wales, which shall have exclusive jurisdiction.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes indicates your acceptance of the modified Terms. We recommend reviewing these Terms periodically to stay informed of any updates.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions.
